These Terms of Service ("Terms") govern your access to and use of ProbateByYou.com, operated by Kathlene J. Avila ("we," "our," or "us"). By purchasing access to or using ProbateByYou.com, you agree to these Terms in full. If you do not agree, do not use or purchase access to this service.

1. Not Legal Advice

    Important: ProbateByYou.com provides general informational guidance about the probate process based on the personal experience of the author. It is not legal advice and does not create an attorney-client relationship. The author is not an attorney. Laws vary by state and change over time. For complex estates, disputes among heirs, or any situation where you are uncertain, you should consult a licensed attorney in your state.
  

Results will vary depending on the specific facts of your estate, the county where you file, and changes in applicable law. We make no guarantee that following this guide will result in any particular outcome.

2. What You Are Purchasing

When you purchase access to ProbateByYou.com, you are purchasing a personal, non-transferable license to access our digital interactive guide. Your purchase includes:

Online access to the ProbateByYou.com interactive guide for the state(s) purchased
Access to all letter templates, checklists, accounting tools, and court forms guidance included in the guide
Access to future updates to that state's guide for as long as the service is operating

Your access is tied to the email address used at checkout and is for your personal use only. You may not share, resell, or transfer your access code to others.

3. No Refund Policy

    All sales are final. No refunds are issued once access to the guide has been granted.
  

Because ProbateByYou.com is a digital product and access is granted immediately upon purchase, we do not offer refunds after an access code has been issued - regardless of whether you have used the guide. This policy is clearly disclosed at the time of purchase and must be acknowledged before completing checkout.

If you experience a technical problem that prevents you from accessing the guide, contact us at probatebyyou@outlook.com and we will resolve it promptly.

Initiating a chargeback or payment dispute with your bank after receiving a valid access code constitutes a breach of these Terms. We maintain records of all purchases, access code deliveries, and acknowledgments, which will be submitted as evidence in any dispute.

4. Chargebacks and Disputes

Before initiating a dispute with your bank or credit card company, please contact us directly at probatebyyou@outlook.com. We will work with you to resolve any issue.

If a chargeback is filed after access has been granted and the no-refund policy was acknowledged at checkout, we will contest the chargeback and submit the following evidence to Stripe:

Your acknowledgment of the no-refund policy at time of purchase (timestamp and checkbox confirmation)
Proof of access code delivery to your email address
Your purchase record and session details

5. Accuracy of Information

We make every effort to ensure the information in our guides is accurate and up to date. However, probate laws change and vary by county. We do not warrant that all information is current, complete, or applicable to your specific situation. You are responsible for verifying current requirements with your local Superior Court clerk before filing any documents.

6. Limitation of Liability

To the maximum extent permitted by law, ProbateByYou.com and Kathlene J. Avila shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of or reliance on this guide, including but not limited to court filing errors, missed deadlines, or any outcome in a probate proceeding.

Our total liability to you for any claim related to your use of ProbateByYou.com shall not exceed the amount you paid for your access.

7. Intellectual Property

All content on ProbateByYou.com - including the guide text, letter templates, checklists, and design - is the original work of Kathlene J. Avila and is protected by copyright. Your purchase grants you a personal license to use the content for your own estate administration. You may not reproduce, distribute, publish, or create derivative works from any content on this site without written permission.

8. Acceptable Use

You agree not to:

Share your access code with others
Attempt to circumvent the access control system
Use this guide to provide legal advice to third parties for compensation
Reproduce or republish any content from this site

9. Service Availability

We strive to keep ProbateByYou.com available at all times but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the service with reasonable notice. In the event of permanent discontinuation, we will provide at least 30 days' notice by email.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the courts of Florida.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects any changes. Continued use of ProbateByYou.com after changes constitutes acceptance of the updated Terms.
